Terms of Sale

1.1 These Terms of Sale (hereinafter the Terms) of the CODEPARTS OÜ e-store govern the legal relationships between the e-store located at www.smartinhome.ee (registry code 12609153, VAT number EE101768584, location Vinkli tn 15, Mustamäe linnaosa, 12618 Tallinn, Harju maakond, Estonia, phone +372 55574065, e-mail info@smartinhome.ee, hereinafter the Seller) and the user of the e-store (hereinafter the User) arising from the use of the e-store and the transactions concluded within it.

1.2 The e-store service allows the User to enter into a purchase and sale agreement with the Seller for the goods sold in the smartinhome.ee environment (hereinafter the Goods). In addition, the User can use other services provided by the Seller on the Internet.

1.3 Before executing a purchase-sale transaction regarding the Goods, the User confirms that they have read the Terms, agree to fulfill and follow them, and consider them as binding conditions of the transaction concluded with the Seller. A User who does not agree to the terms is prohibited from concluding a purchase and sale transaction.

1.4 In addition to the Terms, the legal relations between the Seller and the User are governed by the legislation in force in the Republic of Estonia.

2.1 The Seller is CODEPARTS OÜ (registry code 12609153, VAT number EE101768584, location Vinkli tn 15, Mustamäe linnaosa, 12618 Tallinn, Harju maakond, Estonia, phone +372 55574065, e-mail info@smartinhome.ee).

2.2 The User can be a natural person who is at least 18 years old or any legal person who, before performing a purchase and sale transaction, confirms that they have read the Terms and agree to comply with them.

2.3 If the natural person User is under 18 years of age, by completing the transaction, the User confirms that the transaction has been approved in advance by their legal representative.

3.1 The prices of all Goods sold at the smartinhome.ee e-store are in euros and include the VAT applicable in the Republic of Estonia at the time of the transaction.

3.2 The Seller has the right to change the prices of the Goods at any time without notice. If the Seller changes the prices after the User has placed an order, the Seller undertakes to sell the Goods to the User at the price valid at the time the transaction was concluded.

3.3 In the event of a mistake (technical error, employee error) where the price of the Goods is unreasonably cheap compared to the normal market price, the Seller has the right to withdraw from the transaction, provided the Goods have not yet been dispatched.

3.4 The User must consider that due to technical characteristics, the inventory of the Goods reflects the actual situation with a time shift. The Seller is not responsible if, immediately after the User has paid, it turns out that the Goods are out of stock. In this case, the Seller has the right to withdraw from the transaction.

3.5 The product photos displayed on the product information page are illustrative. For a complete overview of the Goods, the User has the right to contact the Seller by e-mail at info@smartinhome.ee or by phone at +372 55574065.

3.6 By using the web environment in Estonian, the Buyer consents to the display of information on the Goods in another language. For additional information in Estonian, the Buyer can request it via info@smartinhome.ee.

4.1 To perform a purchase and sale transaction, the User must add the desired Goods to the virtual shopping cart.

4.2 After selecting the Goods, the User must click on the "Checkout" link to proceed.

4.3 The Transportation Cost is automatically added to the price to be paid by the User.

4.4 The User must enter the requested data and click "Continue".

4.5 When submitting an order, the User must select the method of payment:

4.5.1 via the internet bank link;

4.5.2 by invoice;

4.5.3 by installments.

4.6 After choosing the method of payment, the User must complete their order by filling in the virtual form with their personal data.

4.7 The User gives CODEPARTS OÜ the right to process and store their entered personal data.

4.8 By clicking the "Confirm order" button, the User confirms that they have read and agreed to the Terms.

4.9 If the User selected the internet bank link, they will be redirected to the chosen bank.

4.10 If the User selected "Invoice", the Seller will send an invoice in PDF format to the User's e-mail address.

4.11 The transaction is deemed to have been concluded from the moment the Seller has received confirmation of full payment for the Goods.

4.12 If the User has not paid for the Goods within 24 hours of completing the order, the Seller will cancel the order.

5.1 The Seller undertakes to begin fulfilling the order immediately upon receiving information about the conclusion of the transaction.

5.2 The Goods purchased by the User will be delivered to the destination specified by the User. The estimated delivery times are as follows:

Within Estonia: 2–4 working days (products in stock) or 3–5 working days (JIT orders from a partner warehouse).

European Union and other countries: 3–7 working days.

For the delivery of goods, we use the following delivery service providers: DPD, Itella SmartPost, Omniva, DHL, and FedEx.

5.3 If the destination of the Goods is outside the Republic of Estonia, the Seller will specify the delivery time separately.

5.4 If the Goods are not in stock and must be specially ordered, the Seller will notify the User within 2 working days and inform them of the approximate delivery time.

5.5 The Seller is not responsible for delivery delays caused by inaccuracies in the personal data provided by the User.

5.6 Before signing the delivery note, the User must inspect the Goods and make a note of any external damage. Non-conforming Goods must be reported to info@smartinhome.ee.

5.7 When receiving the Goods, the User must carefully open the packaging without damaging it.

5.8 Payment methods in the e-store. By paying for products via a bank link, your security is guaranteed.

5.8.1. Via bank link: Swedbank, SEB, Luminor, LHV, Coop.

5.8.3. Payment by invoice for legal entities. CODEPARTS OÜ is the responsible processor of personal data and transmits the necessary personal data for making payments to the authorized processor Maksekeskus AS.

6.1 The User has the right to withdraw from the contract if the delivery of the Goods is delayed beyond the specified deadline due to reasons attributable to the Seller.

6.2 The natural person User has the right to withdraw from the purchase and sale agreement within 14 calendar days from receipt of the Goods by submitting a written withdrawal statement.

6.3 The User does not have the right to withdraw from the contract if the Goods are:

6.3.1 made taking into account the User's personal needs;

6.3.2 manufactured according to the conditions provided by the User;

6.3.3 in a sealed package that is not suitable for return for health protection or hygiene reasons and has been opened;

6.3.4 computer software in a closed case, if opened.

6.4 Upon withdrawal, the Seller undertakes to return the purchase price paid for the Goods to the User.

6.5 The Seller transfers the money back to the User's bank account no later than 14 calendar days after receiving the withdrawal statement, provided the Goods have been returned.

6.6 The returned Goods must be complete (including all items in the packaging).

6.7 The User bears the direct transport costs related to the return of the Goods, unless the Goods do not correspond to the description in the smartinhome.ee e-store.

6.8 If the returned Goods have deteriorated due to use beyond what is necessary to ascertain their nature, properties, and functioning, the Seller has the right to offset the decrease in value against the refunded amount.

6.9 If the User does not agree with the decrease in value, they have the right to involve an independent expert.

6.10 The Seller has the right to withdraw from the transaction if, due to a technical error, the price was unreasonably cheap, or if the Goods are out of stock.

6.11 Both parties have the right to use other legal remedies provided by law in case of a breach of the Terms.

6.12 The claim handling time is 15 days, and the refund deadline is 14 days from the decision if the product cannot be replaced or repaired.

7.1 The Seller is responsible for defects that appear within 2 years from the handover of the Goods to the User.

7.2 The User must notify the Seller of a defect no later than two months after its discovery.

7.3 The User has the right to require the Seller to repair or replace the Goods.

7.4 The Seller is not responsible for defects caused by the User's fault or improper use.

7.5 The Goods may also be covered by a sales guarantee given by the manufacturer. For warranty issues, contact the Seller at info@smartinhome.ee.

8.1 User privacy is important to the Seller. These privacy conditions ensure clarity on how the Seller collects, uses, and stores personal data.

8.2 The Seller complies with the EU Data Protection Directive and the General Data Protection Regulation (GDPR).

8.3 The Seller collects data about the User resulting from the use of the smartinhome.ee environment for order processing, communication, and marketing (with consent).

8.4 The Seller collects log information and other related data.

8.5 The Seller has the right to collect other data with the User's consent.

8.6 The User has the right to refuse to provide certain personal information.

8.7 The Seller uses the collected data to offer Goods and services, analyze the market, and process orders.

8.8 The Seller will not disclose the User's personal data to third parties for independent marketing purposes without consent.

8.9 The Seller may disclose data to service providers (e.g., Maksekeskus AS), financial companies, or if required by law.

8.10 The Seller stores the User's personal data for 59 months. The User can request data deletion or modification via e-mail.

8.11 The User agrees to the collection and processing of personal data according to the Terms.

8.12 The Seller retains information only as long as necessary.

8.13 The web environment uses cookies and other technologies to improve the user experience.

8.14 Cookies remember login data and help determine popular sections of the website.

8.15 The User can set their web browser to disable cookies.

8.16 Blocking cookies may affect the use of certain services.

8.17 The Seller does not knowingly collect personal data from minors.

8.20 The Seller has the right to unilaterally change the privacy conditions.

8.21 The Seller is not responsible for the content or privacy conditions of linked external web environments.

8.22 All photos on the website are for illustrative purposes.

9.1 All copyrights to the works presented in the smartinhome.ee e-store belong to the Seller.

9.2 The User has the right to save these terms of use.

9.3 The Seller has the right to change the Terms unilaterally. Changes take effect upon publication on www.smartinhome.ee.

9.4 The Seller is not responsible for damage caused by force majeure.

9.5 Disputes shall be resolved through negotiations. If an agreement is not reached, the User has the right to appeal to the Consumer Disputes Committee or the court.

9.6 If the User is a legal entity, consumer protection provisions do not apply.

10.1 If the purchased product does not suit you, you have the right to return it within 14 days for a refund.

10.2 To return the product, please send a free-form withdrawal application to info@smartinhome.ee.

10.3 In the event of deterioration of the returned goods, the Buyer is responsible for the decrease in value due to the use of the goods beyond what is necessary to ascertain their nature, characteristics, and functioning.

10.4 We will refund the returned product to the Buyer's bank account without delay, but no later than 14 days after receiving the withdrawal statement.

10.5 For health protection or hygiene reasons, goods in unsealed packaging that are not suitable for return cannot be returned.

10.6 CODEPARTS OÜ is the responsible processor of personal data and transmits the necessary personal data for making payments to the authorized processor Maksekeskus AS.
